Under the Fifth Schedule of the East African Community Customs Management Act (EACCMA), Kenyan citizens permanently relocating from the Philippines back to Kenya are legally entitled to import their personal household effects and one motor vehicle duty-free.
This framework exempts eligible individuals from paying Import Duty, Excise Duty, Value Added Tax (VAT), and the Import Declaration Fee (IDF).
Core Eligibility Benchmarks
To qualify for returning resident status, applicants must meet the following statutory thresholds verified by Customs:
- Age and Residence: The applicant must be at least 18 years of age and have continuously resided outside the Republic of Kenya for a minimum of two (2) consecutive years.
- Permanent Change of Status: The citizen must be bona fide changing their residence permanently back to Kenya, not returning from a brief or temporary non-residential visit.
- Prior Exemption Check: The individual must not have enjoyed a similar returning resident tax exemption within the preceding four (4) years.
Exemption Categories & Conditions
Personal and Household Effects
- Scope: Used clothing, personal items, furniture, and major household appliances.
- Conditions: All items must have been in the applicant's personal or household use at their former residence in the Philippines for at least twelve (12) months prior to packing. Goods must be imported into Kenya within three (3) months of the passenger's arrival date.
Motor Vehicle Duty-Free Importation
- Scope: One (1) passenger motor vehicle per returning resident (excluding buses, minibuses, or commercial cargo vehicles exceeding two tonnes).
- Ownership Rule: The individual must have personally owned and registered the vehicle outside Kenya for at least twelve (12) months prior to shipment.
- Age Limit: The vehicle must be less than eight (8) years old from the year of its first registration.
- The Left-Hand Drive (LHD) Replacement Rule: Because vehicles registered in the Philippines are Left-Hand Drive, they cannot be legally registered in Kenya. Returning residents from the Philippines must apply directly to the Commissioner of Customs for a waiver. This waiver permits the citizen to purchase and import a Right-Hand Drive (RHD) replacement vehicle from an alternative source country duty-free, provided its customs value does not exceed that of the previously owned LHD vehicle.
Step-by-Step Customs Clearing Guide
Compile Flight and Residency Proof
- Gather your original travel passports (including expired ones) showing your Philippine entry/exit visas and Bureau of Immigration stamps. Secure formal termination of employment letters or university completion certificates as proof of your stay abroad.
Consolidate Freight Documentation
- Obtain your original Bill of Lading or Air Waybill, itemized Packing List, and the commercial purchase invoices or foreign logbooks for any RHD replacement vehicle.
Nominate a Licensed Clearing Agent
- Log into your itax.kra.go.ke portal. Access the Customs module and issue an official Electronic Letter of Authority nominating an accredited, KRA-licensed Customs Clearing Agent to manage the filing.
Lodge Waiver in iCMS
- Your clearing agent will upload the complete documentation dossier into the Integrated Customs Management System (iCMS) at the port of entry (Mombasa Port or JKIA Nairobi). Customs officers will audit the residency stamps and vehicle age before granting a formal duty-free release.
